この利用規約（以下「本規約」）は、株式会社墨尚（以下「当社」）が提供する Lingvue のアプリ、クラウド機能、観客用ウェブページおよび関連サービス（以下「本サービス」）の利用条件を定めるものです。本サービスを利用した時点で、本規約に同意したものとみなします。

These Terms govern your use of Lingvue apps, cloud features, viewer pages and related services provided by BOKUSHO Co., Ltd. By using the Service you agree to these Terms.

第1条 本サービスの内容The Service

本サービスは、音声をリアルタイムで字幕化・翻訳する機能を提供します。基本機能は端末内で動作し、無料で利用できます。クラウド補正・クラウド認識（以下「クラウド機能」）は、体験ポイントまたは購入したクラウドポイントで利用できます。

The Service turns speech into live captions and translations. Core features run on your device for free. Cloud correction and cloud recognition ("Cloud Features") use trial points or purchased Cloud Points.

第2条 アカウントAccounts

  1. クラウド機能の利用にはアカウント登録が必要です。登録情報は正確に入力してください。Cloud Features require an account with accurate information.
  2. アカウントは本人のみが利用できます。ログイン情報の管理は利用者の責任とし、第三者による利用が判明した場合は直ちに当社にご連絡ください。Accounts are personal. Keep your sign-in secure and tell us immediately about any unauthorized use.
  3. 体験ポイントは 1 人・1 台につき 1 回限りです。複数アカウントの作成等により重複して取得することを禁止します。Trial points are limited to one per person and per device; creating multiple accounts to obtain more is prohibited.

第3条 クラウドポイントCloud Points

  1. クラウドポイントは資金決済法上の前払式支払手段です。1 ポイントでクラウド補正を 1 分、クラウド認識は 1 分あたり 3 ポイントを消費します。Cloud Points are prepaid payment instruments under Japan's Payment Services Act. 1 point = 1 minute of cloud correction; cloud recognition uses 3 points per minute.
  2. 購入したポイントに有効期限はありません。無償で付与したポイントは、付与時に案内する期限までとし、購入したポイントより先に消費します。Purchased points never expire. Free points expire as stated when granted and are used before purchased points.
  3. ポイントは、法令に定める場合を除き、払い戻し・換金・第三者への譲渡はできません。App Store で購入した場合の返金は Apple の規定に従います。Points are non-refundable, non-exchangeable and non-transferable except as required by law. App Store refunds follow Apple's policies.
  4. アカウントを削除した場合、未使用のポイントは失効します。Unused points are forfeited when you delete your account.
  5. 通信の失敗により同じ文が再送された場合、当社はポイントを二重に消費しないよう処理します。If a sentence is resent due to a network failure, points are not charged twice.

第4条 字幕・翻訳の正確性Accuracy of captions and translations

字幕と翻訳は自動処理によるもので、誤り・欠落・遅延が生じることがあります。医療・法律・契約・安全に関わる判断など、正確性が不可欠な場面では、専門の通訳者や原文による確認を併用してください。

Captions and translations are automated and may contain errors, omissions or delays. Where accuracy is critical—medical, legal, contractual or safety decisions—use a professional interpreter or verify against the original.

第5条 利用者の責任Your responsibilities

本サービスで会話・講演等を字幕化・共有・記録する場合は、話者・参加者への周知や同意の取得など、必要な配慮を利用者の責任で行ってください。

When you caption, share or record conversations or talks, you are responsible for informing participants and obtaining any consent required.

第6条 禁止事項Prohibited conduct

  • 法令または公序良俗に反する行為、他者の権利を侵害する行為Illegal acts or infringing the rights of others
  • 本サービスのサーバーへの過度な負荷、不正アクセス、回数制限の回避Overloading, unauthorized access or circumventing rate limits
  • アプリの改ざん、リバースエンジニアリング（法令で認められる場合を除く）Tampering with or reverse-engineering the apps, except as permitted by law
  • 体験ポイントの不正取得、ポイント・アカウントの売買Obtaining trial points fraudulently, or selling points or accounts
  • クラウド機能を本サービス以外の目的（他の AI サービスの代替等）に利用することUsing Cloud Features for purposes outside the Service

第7条 利用停止Suspension

利用者が本規約に違反した場合、当社は事前の通知なくアカウントの利用停止、ポイントの無効化等の措置をとることがあります。

If you breach these Terms, we may suspend your account or invalidate points without prior notice.

第8条 サービスの変更・中断Changes and interruptions

当社は、保守、障害、委託先の停止その他やむを得ない事由により、クラウド機能の全部または一部を中断することがあります。この間も端末内の基本機能は利用できます。本サービスを終了する場合は、相当の期間をおいて告知し、未使用の購入ポイントは法令に従い払い戻します。

We may interrupt Cloud Features for maintenance, outages or provider issues; on-device features keep working. If we end the Service, we will give reasonable notice and refund unused purchased points as required by law.

第9条 知的財産Intellectual property

本サービスに関する権利は当社または正当な権利者に帰属します。利用者が作成した字幕・用語集の権利は利用者に帰属し、当社はクラウド処理に必要な範囲でのみ利用します。

Rights in the Service belong to us or our licensors. Captions and glossaries you create remain yours; we use them only as needed for cloud processing.

第10条 免責・責任の制限Disclaimer and limitation of liability

当社は、本サービスに起因して利用者に生じた損害について、当社の故意または重大な過失による場合を除き、損害発生前 12 か月間に利用者が当社に支払った金額を上限として責任を負います。消費者契約法その他の法令によりこの制限が適用されない場合は、法令に従います。

Except for our intent or gross negligence, our liability is limited to the amount you paid us in the 12 months before the damage. Where consumer-protection law does not allow this limit, the law applies.

第11条 規約の変更Changes to these Terms

当社は、民法の定めに従い本規約を変更することがあります。変更内容と効力発生日は本ページおよびアプリ内で事前に告知します。

We may change these Terms in accordance with the Civil Code, announcing changes and their effective date in advance on this page and in the app.

第12条 準拠法・管轄Governing law and jurisdiction

本規約は日本法に準拠し、本サービスに関する紛争は大阪地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms are governed by the laws of Japan. The Osaka District Court has exclusive jurisdiction as the court of first instance.
